We collect information from you, when you register as a customer on our site, place an order or fill out a form.
Our Commitment to Your Privacy
Way South Pty Ltd is committed to protecting your personal information and handling it responsibly. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained within it. As a licensed telecommunications carrier, we also have specific obligations under the Telecommunications Act 1997 (Cth) and the Telecommunications (Interception and Access) Amendment (Data Retention) Act 2015 (Cth).
This policy explains what information we collect, why we collect it, how we use and protect it, and your rights in relation to it.
What Information Do We Collect?
We collect personal information that is necessary to provide our services and meet our legal obligations. This may include:

- Payment information (processed securely through our payment provider – we do not store card numbers)
- Details about the services you use, including connection type and equipment

Mandatory Data Retention
As a licensed carrier, Way South is required by law to retain certain categories of telecommunications metadata for a minimum of two years under the Telecommunications (Interception and Access) Amendment (Data Retention) Act 2015(Cth).
The categories of data we are required to retain include:
- Account holder identity and service information
- The source and destination of communications (such as IP addresses)
- The date, time, and duration of communications or connections
- The type of communication and the service used
- The location of equipment at the time of communication
We do not retain the content of your private communications. Retained metadata is stored securely and is only disclosed to authorised law enforcement and government agencies in accordance with the requirements of the Telecommunications (Interception and Access) Act 1979 (Cth). We will not voluntarily disclose retained data to any other third party.
How Do We Protect Your Information?
We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification, or disclosure. This includes:
- Secure storage of customer records and account data
- Access controls limiting who within our organisation can view personal information
- Use of reputable, secure third-party systems for billing and payment processing
- Regular review of our security practices
While we take these precautions, no data transmission or storage system is completely secure. If you believe your account has been compromised, please contact us immediately.
Cookies and Website Data

Complaints
If you believe we have handled your personal information in a way that breaches the Australian Privacy Principles, you may lodge a complaint with us in the first instance. We will investigate and respond within 30 days.
If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au, or the Telecommunications Industry Ombudsman (TIO) at tio.com.au where the matter relates to a telecommunications service.
Changes to This Policy
We may update this policy from time to time to reflect changes in our practices or legal obligations. The current version will always be available on our website. This policy was last updated in April 2026.
